1. Acceptance of Terms

By downloading, installing, or using James, you agree to be bound by these Terms. If you do not agree, do not use the App and delete your account if you have one.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

James is a personal meeting assistant that:

• Records audio of conversations and meetings
• Generates AI-powered transcripts and structured notes
• Identifies speakers with your manual confirmation
• Builds communication profiles from confirmed speaker data
• Provides communication coaching insights

3. Account and Authentication

• You must sign in with Apple or Google to use James
• You are responsible for maintaining the security of your account
• You must not share your account credentials or allow others to access your account
• You must provide accurate information when creating your account

4. Permitted Use

James is intended for:

• Personal communication coaching and self-improvement
• Meeting note-taking with the knowledge and consent of all participants
• Building personal communication profiles for your own reference

You must:

• Obtain consent from all participants before recording any conversation
• Comply with all applicable local, state, national, and international laws regarding recording conversations
• Use the App only for lawful purposes

5. Prohibited Conduct

You must not:

• Record conversations without the knowledge and consent of all participants
• Use James for surveillance, unauthorized monitoring, or covert recording
• Attempt to access, view, or modify other users' data
• Reverse-engineer, decompile, or disassemble any part of the App
• Use the App to harass, intimidate, or harm others
• Redistribute, sublicense, or commercially exploit the App
• Circumvent any security measures or access controls
• Use the App for any unlawful or unauthorized purpose
• Interfere with or disrupt the App's infrastructure or services

6. Your Content

6.1 Ownership

You retain ownership of all content you create using James, including recordings, transcripts, notes, and profiles.

6.2 License to Us

You grant us a limited, non-exclusive license to process your content solely to provide the App's features (transcription, note generation, profile analysis). We do not use your content for any other purpose.

6.3 Deletion

You can delete your content at any time through the App. Deletion is permanent and includes all derived data (transcripts, notes, and profile contributions from deleted recordings).

6.4 Responsibility

You are solely responsible for the content you create and for ensuring you have the right to record and process conversations involving other people.

7. AI-Generated Content

7.1 Nature of AI Output

James uses artificial intelligence to generate transcripts, meeting notes, communication profiles, and coaching suggestions. AI-generated content is:

• Provided for informational and personal development purposes only
• Not guaranteed to be accurate, complete, or error-free
• Not a substitute for professional advice (legal, medical, psychological, or otherwise)

7.2 Your Responsibility

You are responsible for reviewing and verifying all AI-generated content. We are not liable for decisions or actions you take based on AI-generated output.

8. Intellectual Property

8.1 Our Rights

The App, including its design, code, features, and branding, is owned by Samarvir Singh and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the App as intended.

8.2 Feedback

If you provide feedback or suggestions about the App, we may use them without obligation to you.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI-generated content will be accurate or complete
• The App will meet your specific requirements
• Defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law, including recording consent laws
• Your content or your use of AI-generated content

12. Termination

12.1 By You

You may stop using James at any time. You can delete your account and all associated data from the App's Settings.

12.2 By Us

We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the service. We will make reasonable efforts to notify you before termination.

12.3 Effect of Termination

Upon termination, your right to use the App ceases. Your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer operates, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of James.
